Federal Judge Vacates Capital Conviction from Newport News

U.S. District Judge James R. Spencer of the Eastern District of Virginia vacated the capital murder conviction of David W. Boyce on Tuesday, March 19, 2013.  The court issued a memorandum opinion stating that Boyce was denied due process because the state failed to turn over a photograph that may have shown that a witness in the prosecution’s case had testified falsely at Mr. Boyce’s trial more than two decades ago.  Read the full story here.
