Fairfax County No Operator’s License

Driving without a license charges in Fairfax Virginia can be serious. Virginia law prohibits driving without a valid driver’s license. People are charged with this offense when they have never had a valid license. Sometimes people are charged with not having a valid license because they have an old suspension or revocation after which they never reinstated their license with the DMV. Sometimes, a police officer will use this charge for a driver who has moved to Virginia from another state and never updated their license. A first offense is a class 2 misdemeanor and subsequent violations are a class 1 misdemeanor. Upon conviction a court can suspend the defendant’s ability to drive for up to 90 days. During this suspension period the defendant would not be able to apply for a Virginia license.

Typically in Fairfax County, a first offense for driving without a valid license is punished by a fine. A second offense may include a fine plus suspended jail time. On a third or subsequent offense an active jail sentence is a very real possibility.

If you are charged with not having a valid operator’s license in Fairfax, Virginia, you should consult an experienced traffic attorney. Even if it is your first offense, an attorney may be able to help you avoid future serious consequences and help you determine how you can receive a valid license.
